1. Preamble

We are VMB Academy, a company dedicated to helping young athletes reach their full potential, both physically and mentally. Through our coaching services, personalized training programs, performance analysis and progress monitoring, we provide every athlete with the tools to succeed. Our vision is based on the use of innovative technologies such as artificial intelligence to provide tailor-made plans, as well as a strong community to support and encourage young athletes on their journey.

These Terms of Use (TOU) define the legal framework governing the use of the services, products, content and features offered by VMB Academy. By registering and using our services, you accept these T&Cs in their entirety.

2. Scope of application

2.1. Parties to the contract and object of the contract

These GTC govern the user agreement between you, the user, and VMB Academy, operated by [Company name] (hereinafter referred to as “VMB Academy” or “we”), [address]. This contract covers the free or paid use of the services offered on our mobile application and online platforms, accessible via mobile devices or other connected equipment.

2.2 Conditions of participation

Use of the VMB Academy services is reserved for persons aged 15 or over. Minors must obtain the explicit consent of their parents or legal guardians to use the services. For paid services, such as premium subscriptions, you must be at least 18 years old and have full legal capacity. Minors must obtain explicit consent from their parents or legal guardians to use the services.

2.3 Additional conditions

Certain features of VMB Academy may be subject to additional conditions. These specific conditions will be presented prior to the use of these features, and will only become an integral part of the contract after your express acceptance.

3. Services and prices

3.1 Free or paid services

The VMB Academy application offers both free and paid services. Users can access all basic functions free of charge. However, access to personalized programs, contacts with recruiters and extended functionalities may require a paid subscription.

Details of the different subscription levels and the features they include are available directly in the application, as well as on the official VMB Academy website. These paid services may be offered as monthly, annual or one-off subscriptions.

3.2. Equipment requirements

Some VMB Academy training programs may require specific equipment, such as dumbbells, elastic bands or exercise machines. This equipment is not provided by VMB Academy and is the responsibility of the user.

3.3. Prices and modifications

All prices for paid services are quoted in euros and include all applicable taxes. The prices in effect at the time of subscription are those that apply. VMB Academy reserves the right to modify prices at any time. Any price changes will be communicated in advance, and will only apply to future subscriptions or renewals.

4. Your health

4.1. Physical fitness

Use of the VMB Academy services, including training programs and nutritional recommendations, is at your own risk. You must be in good physical condition to take part in the physical activities offered.

If you have a medical history (cardiovascular disease, respiratory disease, musculoskeletal disorders, recent surgery, or other health problems), we strongly recommend that you consult a physician before beginning any training program. VMB Academy declines all responsibility for any injury or health problem resulting from inappropriate use of its services.

4.2. No substitute for medical advice

Information provided by VMB Academy, whether concerning physical training or nutrition, does not constitute medical advice. It is not a substitute for consultation with a healthcare professional. If you experience pain, excessive fatigue, nausea, or any other unusual symptoms, we recommend that you stop training immediately and consult a physician.

5. User account

5.1. Registration process

To access VMB Academy services, you must create a user account by providing valid information, such as your name, e-mail address, and other required information. You can also register using third-party services such as Google, Apple or Facebook.

After registration, you will be asked to accept these T&Cs and our Privacy Policy. You will then receive a confirmation e-mail to finalize the creation of your account. Each user may create only one account. It is strictly forbidden to use false or misleading login information.

5.2. Account security and management

You are solely responsible for the security of your login details. Any activity carried out via your account is binding on you, except in the event of proven compromise of your login details by a third party. If you suspect that your account has been compromised, please inform us immediately.

5.3. Account deletion

You may delete your user account at any time by logging into your personal area. Deleting your account will result in the loss of all data associated with it, including training programs and results.

6. Conclusion of contract

6.1 Registration and subscription

The contract between you and VMB Academy is concluded when you complete your registration or take out a paid subscription. For paid services, the contract is concluded as soon as payment is validated. If you subscribe via a mobile application (for example, via Apple or Google Play), the contract is subject to the terms and conditions of the relevant application store.

6.2. Right of withdrawal

In accordance with the applicable laws, you have a right of withdrawal of 14 days from the conclusion of the contract. If you wish to exercise this right, you must inform us in writing before the expiry of this period. In the event of a valid withdrawal, we will refund the sums paid, less any charges for services already rendered.

7. Duration and termination

7.1. Contract duration

The user contract is concluded for an indefinite period as soon as you create an account or take out a subscription. Paid subscriptions are concluded for the duration selected at the time of purchase (monthly, annual, or other) and are automatically renewed at the end of the initial period, unless terminated.

7.2. Cancellation

You may cancel your paid subscription at any time via your account settings. Termination will take effect at the end of the current billing period. No request for a refund for the remaining period will be accepted.

We reserve the right to unilaterally terminate your contract in the event of a serious breach of these T&Cs, or in the event of behavior detrimental to the VMB Academy community.

8. Terms of payment

8.1. Payment

Payment for paid services can be made via the payment methods available on the application (credit card, PayPal, Apple Pay, Google Pay, etc.). All payments must be made prior to accessing premium services.

8.2. Late payment

In the event of late payment, we reserve the right to suspend access to premium services until the situation has been rectified. In the event of persistent non-payment, we reserve the right to terminate your subscription without refund.

9. Protection of personal data

VMB Academy is committed to protecting your personal data in accordance with our Privacy Policy, available on our website and app. We will only share your data with third parties where required by law or with your explicit consent.

10. Intellectual property rights

All content, training programs, images, logos and other elements available on VMB Academy are protected by copyright and intellectual property rights. You are not authorized
